How Disability Benefits Work
Social Security Disability (SSD) benefits are intended for injured individuals who are unable to work for a year or more due to a disability. To qualify for SSD benefits, you must have worked long enough and recently enough in a job that is covered by Social Security. (In other words, you paid into Social Security through withdrawals from your paychecks.)
Not only must your condition prevent you from performing the work you did prior to your injury or illness, but you must also be unable to perform other work. The Social Security Administration (SSA) has developed a list of qualifying medical conditions. Your condition must be on the list or as severe as a medical condition on the list for you to qualify to receive benefits.
Some Applications Are Denied
That sounds straightforward enough. However, many initial applications for SSD benefits are denied. In fact, nearly 70% of initial claims are denied by the SSA. This occurs for a number of reasons. You may not have provided sufficient medical records to prove your disability. You may not be following your doctor’s orders for treating your injury or illness. Or you may simply have not completed the paperwork properly.
The proper step to take after an initial claim is denied is to appeal. The appeal process also has multiple steps and can become overwhelming. It is at this point that many injured people seek help from a knowledgeable SSDI attorney.
